Bombs kill 3 NATO troops, 5 Afghans
KABUL, Afghanistan (AP) ? Roadside bomb attacks in Afghanistan killed three NATO service members and five Afghans on Tuesday, officials said, clear evidence that the insurgents' annual spring offensive is underway.
The service members died in southern Afghanistan, the U.S.-led coalition in Afghanistan said in a brief statement that provided no other information.
In another attack in the south of the country, a roadside bomb in the Shah Wali Kot district of Kandahar province killed three civilians and wounded five, said Jawed Faisal, a spokesman for the provincial governor.
The Taliban and other insurgent groups make heavy use of roadside bombs. They are among the deadliest weapons in the Afghan war for civilians.
In the north, in Archi district in the province of Kunduz, a roadside bomb killed two people, including a local police commander who had been credited with reducing the number of insurgent attacks in his area, said Abdul Nazar, a local council member.
Commander Miran and his driver were killed and two other police officers were wounded when the car they were driving toward Kunduz City was destroyed by a bomb hidden on the road, said Nazar. Like many Afghans, Miran only used one name.
The attacks came on the third day of what Taliban has called its spring offensive. The insurgents warned they would infiltrate enemy ranks to conduct "insider attacks" and target military and diplomatic sites with suicide bombers.
In past years, spring has marked a significant upsurge in fighting between the Taliban and NATO forces along with their local allies. This fighting season is a key test, as the international coalition is scheduled to hand over security responsibilities to Afghan forces next year.
On Tuesday, Afghan and coalition security forces arrested two Taliban insurgents in Logar province, and on Monday Afghan security forces rushed to the assistance of local police under attack in Ghazni province and killed three insurgents and wounded four, NATO said in a statement.

Eyes-on: MIT Media Lab's Smarter Objects can map a user interface onto... anything (video)
While patrolling the halls of the CHI 2013 Human Factors in Computing conference in Paris, we spied a research project from MIT's Media Lab called "Smarter Objects" that turns Minority Report tech on its head. The researchers figured out a way to map software functionality onto tangible objects like a radio, light switch or door lock through an iPad interface and a simple processor / WiFi transceiver in the object. Researcher Valentin Huen explains that "graphical user interfaces are perfect for modifying systems," but operating them on a day-to-day basis is much easier using tangible objects.
To that end, the team developed an iPad app that uses motion tracking technology to "map" a user interface onto different parts of an object. The example we saw was a simple radio with a a pair of dials and a speaker, and when the iPad's camera was pointed at it, a circular interface along with a menu system popped up that cannily tracked the radio. From there, Huen mapped various songs onto different positions of the knob, allowing him to control his playlist by moving it -- a simple, manual interface for selecting music. He was even able to activate a second speaker by drawing a line to it, then "cutting" the line to shut it off. We're not sure when, or if, this kind of tech will ever make it into your house, but the demo we saw (see the pair of videos after the break) seemed impressively ready to go.

This week's diamond jubilee of the discovery of DNA's molecular structure rightly celebrates how Francis Crick, James Watson and their collaborators launched the 'genomic age' by revealing how hereditary information is encoded in the double helix. Yet the conventional narrative ? in which their 1953 Nature paper led inexorably to the Human Genome Project and the dawn of personalized medicine ? is as misleading as the popular narrative of gene function itself, in which the DNA sequence is translated into proteins and ultimately into an organism's observable characteristics, or phenotype.
Sixty years on, the very definition of 'gene' is hotly debated. We do not know what most of our DNA does, nor how, or to what extent it governs traits. In other words, we do not fully understand how evolution works at the molecular level.
That sounds to me like an extraordinarily exciting state of affairs, comparable perhaps to the disruptive discovery in cosmology in 1998 that the expansion of the Universe is accelerating rather than decelerating, as astronomers had believed since the late 1920s. Yet, while specialists debate what the latest findings mean, the rhetoric of popular discussions of DNA, genomics and evolution remains largely unchanged, and the public continues to be fed assurances that DNA is as solipsistic a blueprint as ever.
The more complex picture now emerging raises difficult questions that this outsider knows he can barely discern. But I can tell that the usual tidy tale of how 'DNA makes RNA makes protein' is sanitized to the point of distortion. Instead of occasional, muted confessions from genomics boosters and popularizers of evolution that the story has turned out to be a little more complex, there should be a bolder admission ? indeed a celebration ? of the known unknowns.
DNA dispute
A student referring to textbook discussions of genetics and evolution could be forgiven for thinking that the 'central dogma' devised by Crick and others in the 1960s ? in which information flows in a linear, traceable fashion from DNA sequence to messenger RNA to protein, to manifest finally as phenotype ? remains the solid foundation of the genomic revolution. In fact, it is beginning to look more like a casualty of it.
Although it remains beyond serious doubt that Darwinian natural selection drives much, perhaps most, evolutionary change, it is often unclear at which phenotypic level selection operates, and particularly how it plays out at the molecular level.
Take the Encyclopedia of DNA Elements (ENCODE) project, a public research consortium launched by the US National Human Genome Research Institute in Bethesda, Maryland. Starting in 2003, ENCODE researchers set out to map which parts of human chromosomes are transcribed, how transcription is regulated and how the process is affected by the way the DNA is packaged in the cell nucleus. Last year, the group revealed that there is much more to genome function than is encompassed in the roughly 1% of our DNA that contains some 20,000 protein-coding genes ? challenging the old idea that much of the genome is junk. At least 80% of the genome is transcribed into RNA.
Some geneticists and evolutionary biologists say that all this extra transcription may simply be noise, irrelevant to function and evolution. But, drawing on the fact that regulatory roles have been pinned to some of the non-coding RNA transcripts discovered in pilot projects, the ENCODE team argues that at least some of this transcription could provide a reservoir of molecules with regulatory functions ? in other words, a pool of potentially 'useful' variation. ENCODE researchers even propose, to the consternation of some, that the transcript should be considered the basic unit of inheritance, with 'gene' denoting not a piece of DNA but a higher-order concept pertaining to all the transcripts that contribute to a given phenotypic trait.

Sea surface temperatures reach highest level in 150 years on Northeast continental shelf
Apr. 26, 2013 ? Sea surface temperatures in the Northeast Shelf Large Marine Ecosystem during 2012 were the highest recorded in 150 years, according to the latest Ecosystem Advisory issued by NOAA's Northeast Fisheries Science Center (NEFSC). These high sea surface temperatures (SSTs) are the latest in a trend of above average temperature seen during the spring and summer seasons, and part of a pattern of elevated temperatures occurring in the Northwest Atlantic, but not seen elsewhere in the ocean basin over the past century.
The advisory reports on conditions in the second half of 2012.
Sea surface temperature for the Northeast Shelf Ecosystem reached a record high of 14 degrees Celsius (57.2?F) in 2012, exceeding the previous record high in 1951. Average SST has typically been lower than 12.4 C (54.3 F) over the past three decades.
Sea surface temperature in the region is based on both contemporary satellite remote-sensing data and long-term ship-board measurements, with historical SST conditions based on ship-board measurements dating back to 1854. The temperature increase in 2012 was the highest jump in temperature seen in the time series and one of only five times temperature has changed by more than 1 C (1.8 F).
The Northeast Shelf's warm water thermal habitat was also at a record high level during 2012, while cold water habitat was at a record low level. Early winter mixing of the water column went to extreme depths, which will impact the spring 2013 plankton bloom. Mixing redistributes nutrients and affects stratification of the water column as the bloom develops.
Temperature is also affecting distributions of fish and shellfish on the Northeast Shelf. The advisory provides data on changes in distribution, or shifts in the center of the population, of seven key fishery species over time. The four southern species -- black sea bass, summer flounder, longfin squid and butterfish -- all showed a northeastward or upshelf shift. American lobster has shifted upshelf over time but at a slower rate than the southern species. Atlantic cod and haddock have shifted downshelf."
"Many factors are involved in these shifts, including temperature, population size, and the distributions of both prey and predators," said Jon Hare, a scientist in the NEFSC's Oceanography Branch. A number of recent studies have documented changing distributions of fish and shellfish, further supporting NEFSC work reported in 2009 that found about half of the 36 fish stocks studied in the Northwest Atlantic Ocean, many of them commercially valuable species, have been shifting northward over the past four decades.
The Northeast U.S. Continental Shelf Large Marine Ecosystem (LME) extends from the Gulf of Maine to Cape Hatteras, North Carolina. The NEFSC has monitored this ecosystem with comprehensive sampling programs since1977. Prior to 1977, this ecosystem was monitored by the NEFSC through a series of separate, coordinated programs dating back decades.
Warming conditions on the Northeast Shelf in the spring of 2012 continued into September, with the most consistent warming conditions seen in the Gulf of Maine and on Georges Bank. Temperatures cooled by October and were below average in the Middle Atlantic Bight in November, perhaps due to Superstorm Sandy, but had returned to above average conditions by December.
"Changes in ocean temperatures and the timing and strength of spring and fall plankton blooms could affect the biological clocks of many marine species, which spawn at specific times of the year based on environmental cues like water temperature," Kevin Friedland, a scientist in the NEFSC Ecosystem Assessment Program, said. He noted that the contrast between years with, and without, a fall bloom is emerging as an important driver of the shelf's ecology. "The size of the spring plankton bloom was so large that the annual chlorophyll concentration remained high in 2012 despite low fall activity. These changes will have a profound impact throughout the ecosystem."
Michael Fogarty, who heads the Ecosystem Assessment Program, says the abundance of fish and shellfish is controlled by a complex set of factors, and that increasing temperatures in the ecosystem make it essential to monitor the distribution of many species, some of them migratory and others not.
"It isn't always easy to understand the big picture when you are looking at one specific part of it at one specific point in time," Fogarty said, a comparison similar to not seeing the forest when looking at a single tree in it. "We now have information on the ecosystem from a variety of sources collected over a long period of time, and are adding more data to clarify specific details. The data clearly show a relationship between all of these factors."
"What these latest findings mean for the Northeast Shelf ecosystem and its marine life is unknown," Fogarty said. "What is known is that the ecosystem is changing, and we need to continue monitoring and adapting to these changes."
Ecosystem advisories have been issued twice a year by the NEFSC's Ecosystem Assessment Program since 2006 as a way to routinely summarize overall conditions in the region. The reports show the effects of changing coastal and ocean temperatures on fisheries from Cape Hatteras to the Canadian border. The advisories provide a snapshot of the ecosystem for the fishery management councils and also a broad range of stakeholders from fishermen to researchers.

Bangladesh building collapse death toll hits 359
SAVAR, Bangladesh (AP) ? Police in Bangladesh took six people into custody in connection with the collapse of a shoddily-constructed building that killed at least 359 people, as rescue workers admitted that voices of survivors are getting weaker after four days of being pinned under the increasingly unstable rubble.
Still, in a boost for the rescuers, 29 survivors were pulled out Saturday, said army spokesman Shahinul Islam.
Most of the victims were crushed by massive blocks of concrete and mortar falling on them when the 8-story structure came down on Wednesday morning ? a time many of the garment factories in the building were packed with workers. It was the worst tragedy to hit Bangladesh's massive garment industry, and focused attention on the poor working conditions of the employees who toil for $38 a month to produce clothing for top international brands.
Among those arrested Saturday were two owners of a garment factory, who a Dhaka court ruled can be questioned by police for 12 days without charges being filed. Also detained are two government engineers and the wife of the building owner, who is on the run, in an attempt to force him to surrender. Late Saturday, police arrested another factory owner. Violent public protests continued sporadically in Dhaka and spread to the southeastern city of Chittagong where several vehicles were set on fire.
Working round-the-clock since Wednesday through heat and a thunderstorm, rescuers on Saturday finally reached the ground floor from the top of the mountainous rubble through 25 narrow holes they have drilled, said Brig. Gen. Ali Ahmed Khan, the head of the fire services.
"We are still getting response from survivors though they are becoming weaker slowly," he said, adding that rescue workers were now able to see cars that were parked at the ground level.
"The building is very vulnerable. Any time the floors could collapse. We are performing an impossible task, but we are glad that we are able to rescue so many survivors." He said the operations will continue overnight as chances fade of people surviving for a fifth day with possibly grievous injuries and the heat.
The building site was a hive of frenzied activity all day with soldiers, police and medical workers in lab coats working non-stop. Rescuers passed bottles of water and small cylinders of oxygen up a ladder leaning against the side of the building to be given to possible survivors inside.
They used bare hands and shovels, passing chunks of brick and concrete down a human chain away from the collapsed structure. On the ground, mixed in the debris were several pairs of pink cotton pants, a mud-covered navy blue sock and a pile of green uncut fabric.
Every once in a while a badly decomposed body would be brought out, covered in cloth and plastic, to a spot where ambulances were parked. Workers furiously sprayed air-fresheners on the bodies to cover the stench, leaving the air thick with the smell of death and cheap perfume.
The bodies were kept at a makeshift morgue at the nearby Adharchandra High School before being handed over to families. Many people milled around at the school, waving photos of their missing loved ones.
Officials at a rescue control center at the scene said Sunday that the death toll had risen to 359. Military spokesman Shahinul Islam said 2,429 survivors were accounted for.
Junior Home Minister Shamsul Haque Tuku said police had arrested Bazlus Samad, managing director of New Wave Apparels Ltd., and Mahmudur Rahman Tapash, the company chairman. He told reporters that police had also detained the wife of Mohammed Sohel Rana, the owner of the collapsed Rana Plaza building, for questioning. The top three floors of the eight-story building were illegally constructed. Military spokesman Shahinul Islam said officials arrested Aminul Islam, chairman of Phantom Apparels Ltd., late Saturday in Dhaka.
Authorities are still searching for Rana, a local politician, who hasn't been seen publicly since the building collapsed. Negligence cases have been filed against him. Police in Bangladesh often detain relatives of missing suspects as a way to pressure them to surrender.
Dhaka police superintendent Habibur Rahman said Rana was a local leader of ruling Awami League's youth front. His arrest, and that of the factory owners, was ordered by Prime Minister Sheikh Hasina, who is also the Awami League leader.
Police said they detained for questioning two engineers working for the Savar municipality, Imtemam Hossain and Alam Ali. They did not say what role they played in approving the design of the building but it was clear that the arrests amounted to a widening crackdown. They spoke on condition of anonymity because they are not authorized to speak to the media.
A garment manufacturers' group said the factories in the building employed 3,122 workers, but it was not clear how many were inside it when it collapsed.
Police say they ordered an evacuation of the building on Tuesday after cracks in Rana Plaza were found, but the factories ignored the order and were operating when it collapsed the next day. Video before the collapse shows cracks in walls, with apparent attempts at repair. It also shows columns missing chunks of concrete and police talking to building operators.
Officials said soon after the collapse that numerous construction regulations had been violated.
The disaster is the worst ever for the country's booming and powerful garment industry, surpassing a fire five months ago that killed 112 people and brought widespread pledges to improve worker-safety standards. Since then, very little has changed in Bangladesh, where low wages have made it a magnet for numerous global brands.
Bangladesh's garment industry was the third largest in the world in 2011, after China and Italy, having grown rapidly in the past decade. The country's minimum wage is the equivalent of about $38 a month.
Among the garment makers in the building were Phantom Apparels, Phantom Tac, Ether Tex, New Wave Style and New Wave Bottoms. Altogether, they produced several million shirts, pants and other garments a year.
The New Wave companies, according to their website, make clothing for several major North American and European retailers.
Britain's Primark acknowledged it was using a factory in Rana Plaza, but many other retailers distanced themselves from the disaster, saying they were not involved with the factories at the time of the collapse or had not recently ordered garments from them.
Wal-Mart said none of its clothing had been authorized to be made in the facility, but it is investigating whether there was any unauthorized production.

Tax cheats pony up $5.5 billion in amnesty programs
WASHINGTON (AP) ? The Internal Revenue Service has recouped more than $5.5 billion under a series of programs that offered reduced penalties and no jail time to people who voluntarily disclosed assets they were hiding overseas, government investigators said Friday.
In all, more than 39,000 tax cheats have come clean under the programs.
But there's more.
Government investigators suspect that thousands of other taxpayers have quietly started reporting foreign accounts without paying any penalties or interest. The number of people reporting foreign accounts to the IRS nearly doubled from 2007 to 2010, to 516,000 accounts, a report by the Government Accountability Office said.
The sharp increase suggests that some people are simply starting to report their accounts without taking part in the disclosure programs, the report said.
"IRS has detected some taxpayers with previously undisclosed offshore accounts attempting to circumvent paying the taxes, interest and penalties that would otherwise be owed," the report said. "But based on GAO reviews of IRS data, IRS may be missing attempts by other taxpayers attempting to do so."
Some taxpayers try to avoid penalties through a technique the IRS calls "quiet disclosure," in which they file amended tax returns that report offshore income from prior years. Others simply declare existing offshore accounts for the first time with their current year's tax return, the report said.
"If successful, these techniques result in lost revenue for the Treasury and undermine the offshore programs' fairness and effectiveness," the report said.
Peter Zeidenberg, a partner at the law firm DLA Piper in Washington, said it's pretty obvious that people are starting to report foreign accounts that probably existed for years.
"I don't think you get an increase like that from people just all of a sudden getting the idea I'm going to open an account in Switzerland," Zeidenberg said.
Acting IRS Commissioner Steven Miller said catching overseas tax dodgers is a top priority of the agency. In a written response to the report, he said the agency is working to improve the way it identifies people who are still trying get around the agency's disclosure programs.
The IRS has run four voluntary disclosure programs since 2003. The last three ? in 2009, 2011 and 2012 ? have yielded almost all of the $5.5 billion in back taxes, penalties and interest. The latest program is still open.
The agency stepped up its efforts in 2009, when Swiss banking giant UBS AG agreed to pay a $780 million fine and turn over details on thousands of accounts suspected of holding undeclared assets from American customers.
The GAO's report looked at data from the 2009 program. More than 10,000 cases from that program have been closed so far. The median account balance: $570,000.
U.S. taxpayers can hold offshore accounts for a number of legitimate reasons, the report says. They may want to diversify their investments, facilitate international business transactions or get easier access to money while living or working overseas.
But, the report notes, "some use them to illegally reduce their tax liabilities, often by not reporting the income earned on these accounts."
Taxpayers with foreign accounts totaling more than $10,000 must report them to the IRS or face stiff penalties.
The IRS has long had a policy that certain tax evaders who come forward can usually avoid jail time as long as they agree to pay back taxes, interest and hefty penalties. Drug dealers and money launderers need not apply. But if the money was earned legally, tax evaders can usually avoid criminal prosecution.
Fewer than 100 people apply for the program in a typical year, in part because the penalties can far exceed the value of the hidden account, depending on how long the account holder has evaded U.S. taxes.
The disclosure programs offered reduced penalties, but they were not a complete amnesty. In the 2009 program, most of the tax cheats were required to forfeit 20 percent of their accounts, the report said.
Miller said the agency is using information from people who have come forward to target banks and financial advisers.
The disclosure programs helped build political momentum to pass a law in 2010 that will require foreign banks to report U.S. account holders to U.S. authorities, said Ian Comisky, partner at Blank, Rome, a law firm based in Philadelphia.
If foreign governments refuse to disclose the information, U.S. banks must withhold 30 percent of certain payments to financial institutions in those countries ? a big incentive for countries to cooperate.
Together, the disclosure programs and the new law offer a powerful incentive for tax dodgers to come clean, Comisky said.
"They are more scared, and they are coming in where they might have been sitting out in the cold," Comisky said. "Now they're trying to come in, even if there's a penalty to do so."

In a survey of over 500 high-net-worth investors, 80% said they thought commercial real estate will equal or top stock market performance over the next five years. The Investment Program Association survey indicated these investors expected to boost their portfolio allocations to non-listed REITs and business development companies (BDCs).?
?The compelling point is what these investors are saying,? Kevin M. Hogan, president and CEO of the IPA, told On Wall Street. ?They are confident about investing in real estate, and they?re voting with their pocketbooks.?
When asked about future holdings, 45% of respondents said they?d likely own non-listed REITs while 24% planned to include BDCs in their portfolio. (BDCs invest in the debt and equity of small companies; Hogan said such investments are primarily real estate-related now.) ?These findings imply a 15 percentage-point increase in ownership of non-listed REITs and an 11 percentage-point jump in BDC investments.
?After the significant downturn in the real estate market, investors are now saying that the market has turned a corner,? Hogan said in a statement. ?In today?s low-interest-rate environment, these ownership levels can help provide investors in non-listed REITs and BDCs with significant current income potential over a multi-year investment horizon.?
According to the IPA, many non-listed REITs pay annual distributions of between 4% and 6% while BDCs often have similar payouts.? Generally, investors should expect to hold non-listed REITs for five years or longer before an exit opportunity (via liquidation, merger or listing) arises.
The IPA cited data from Robert A. Stanger & Co. to indicate that sales of non-listed REITs and BDCs have set records recently.? In 2012, estimated total sales were $10.3 billion for non-listed REITs and $2.8 billion for BDCs. In the first quarter of 2013, those numbers were $3.9 billion and $655.7 million, respectively.
Although BDC programs are relatively new, non-listed REITs have a longer history. Some observers have voiced concern that distributions have contained returns of investors? principal rather than cash flow from operations. Hogan said that such objections have declined recently, due in part to an increasing number of liquidity events from non-listed REITs. ?One study of 17 full-cycle programs showed annualized average returns over 10%,? he said. ?There?s a reason that sales are up so much. Investors see value in these programs.?

NASCAR defends penalties against Matt Kenseth
RICHMOND, Va. (AP) ? Joe Gibbs understands that NASCAR must enforce the rule book and his team deserved a penalty for an illegal part in Matt Kenseth's engine.
The team owner just disagrees with the severity of the penalties levied against Joe Gibbs Racing this week.
More importantly, he's deeply troubled with the perception JGR cheated.
"You spend your life trying to live a certain way. That's a real personal thing and is something that has a big effect on me," said Gibbs, who added that when someone wrongs him, he always searches for intent.
"The first thing I wanted to know was: 'What was their intent?'" Gibbs said Friday. "Was it an accident, was it a mistake or did they purposefully try to do something? That's important to me. This motor and what happened, there was not an attempt to circumvent the rules or have an unfair competitive advantage."
JGR made a strong statement that the organization is weathering this storm in Friday qualifying at Richmond International Raceway, where Kenseth won the pole. Brian Vickers was second to make it an all-JGR front row for Saturday night's race.
The pole-winning run negates at least one portion of the penalty levied against Kenseth on Wednesday, when NASCAR said the pole he won last week at Kansas would not count toward eligibility for next year's preseason race at Daytona.
It was part of a harsh penalty levied by NASCAR, which maintained it's not its responsibility to determine intent or if the infraction provided an advantage when doling out punishment.
"Everybody's asked the same thing ? why aren't things more black and white?" NASCAR vice president of competition Robin Pemberton said. "It's too light. It's too heavy. It's too wide. It's too high. It's too low. It's black and white, and we can't judge the performance because some guys do a better job of it than others, quite frankly."
The issue is not whether the part was illegal, because JGR admits one of eight connecting rods failed to meet the minimum weight requirement. But the engine came from manufacturer Toyota Racing Development, and JGR is questioning the fairness in NASCAR's harsh ruling against the team.
The reasoning, Pemberton said Friday, is two-fold.
"When you talk about engines, you talk about tires, and you talk about fuel, that's a common thread that's been understood, and it's stood the test of time for the last 65 years: Don't mess with those areas, and the penalties are severe," Pemberton said.
But NASCAR also holds the team ultimately responsible for every piece of the car presented at inspection.
"At this time we will not and cannot penalize vendors," Pemberton said. "We'd be at it all day long, whether it was a shock that went bad, a spring that collapsed that caused the car (to be) low or any of those things.
"But when you go down that road, there are a million pieces on these cars, and so we choose to go down the path that it's the team's responsibility for quality control, to check on the parts and pieces that they bring and compete with at the racetrack."
Per NASCAR policy, Kenseth's race-winning engine from Sunday at Kansas was taken back to the North Carolina Research & Development Center for a thorough inspection. Once opened up to NASCAR inspectors, one connecting rod was found to be approximately three grams ? less than the weight of an envelope ? too light.
Kenseth had everything but his trophy taken away, with NASCAR docking him 50 points, plus the three bonus points he earned for the win. Crew chief Jason Ratcliff was fined $200,000 and he and Gibbs were both suspended for six races.
JGR is appealing, so Ratcliff and Gibbs could work Friday at Richmond International Raceway, where Kenseth has gone on record in calling the penalties "grossly unfair" and "borderline shameful."
It's the first technical penalty JGR has appealed in 22 years, Gibbs said.
"One thing that is very important to me is the intent here was not to get an unfair advantage in any way. That's very important to me," said Gibbs, adding that 10 TRD engines have been inspected this year, eight from JGR, without an issue.
"I think basically that's what our appeal is going to be. We want to go forward and go through that process and what we'll be appealing will be the severe nature of the penalties."
Ratcliff also insisted that the No. 20 Toyota had no advantage from the one light connecting rod.
"I respect NASCAR's view on it as far as the part was illegal so by the letter of the law, the part's illegal and there's consequences for that. I do not feel like the spirit of the law was compromised," he said. "That's where we felt like the severity of the penalty is extremely harsh.
"We won Kansas, you can bet your bottom dollar on that. You make that change in that engine and that race doesn't change a bit."
The engines are made by TRD in Costa Mesa, Calif., and shipped to JGR's shop in North Carolina. JGR can't touch the engines beyond installing them in the cars, and TRD has accepted responsibility for the mistake. TRD officials said the manufacturer shipped the part with paperwork that indicated its correct weight, and TRD employees simply missed the fact it was not legal.
Ratcliff argued TRD should have felt the burden of the penalty, not JGR. Although NASCAR did dock Toyota five manufacturer points, the bulk of the penalty went against Gibbs and Ratcliff, who wasn't sure if he would have to pay the $200,000 himself. "I hope not. If I do I'm going to be broke ? we need to start a relief fund," he said.
"Back in the day, most of the engines were built by the race team," Ratcliff said. "Now you have a handful of major engine builders that supply engines to most all the teams in the garage. How do you hold them accountable? I think it's time for some change on how NASCAR approaches it because times have changed so much."
The penalties against JGR came a week after NASCAR penalized Penske Racing for allegedly using illegal parts in the rear suspension of defending champion Brad Keselowski and Joey Logano's cars.
Keselowski and Logano were docked 25 points apiece, their crew chiefs were fined a total of $200,000 and were suspended along with five other Penske employees for six races. Penske's appeal will be heard next Wednesday, and team owner Roger Penske has maintained they were working in a gray area of the rule book.
The Penske and Gibbs cases aren't similar in that Penske has a difference of opinion about a rule, where the Gibbs group will argue the severity of the fines.
Pemberton stood by his rules are rules defense.
"We feel like we're consistent, but not every violation is exactly the same," Pemberton said. "We do our best and we feel like we do a good job interpreting the rules and levying the penalties they deserve."

A significant problem regarding health care access involves obtaining hospital admission for those experiencing a mental health crisis.
The backlog in obtaining insurance approval for admission to a hospital bed is problematic for the patient in crisis, other emergency room patients and physicians.
A research letter to be published in the May issue of the journal Annals of Emergency Medicine argues that pre-authorization process is akin to health care ?rationing by hassle factor.?
?An emergency department is just about the worst place for a psychiatric patient to wait for an inpatient bed, and yet that is exactly what the pre-authorization process forces on millions of these vulnerable people,? said senior author J. Wesley Boyd, M.D., Ph.D.
?The thousands upon thousands of hours emergency physicians spend obtaining prior authorization for admission to the hospital are hours we are not spending on direct patient care. Only Medicare does not require prior authorization for us to admit psychiatric patients to the hospital; maybe they are onto something.?
In the study, researchers recorded data on 53 patients ? most were in the emergency department because they were having suicidal thoughts.
Half of the authorization requests took under 20 minutes to be approved, but 10 percent of the patients? authorizations took an hour or more. Only one of the 53 patients? insurance carriers denied pre-authorization. There are approximately 2.5 million psychiatric admissions to hospitals every year in the U.S.
?Psychiatric care is really the poor stepchild in the world of insurance coverage,? said lead author Amy Funkenstein, M.D., of Brown University in Providence, R.I..
?Insurance carriers reimburse poorly and as a consequence, hospitals often have inadequate resources for patients who urgently need this care. The situation is so dire that ERs are now being designed and configured to house psychiatric patients awaiting placement as inpatients. These patients deserve better.?

LOS ANGELES ? Online privacy is not so private, and that?s OK with Millennials.
A new survey shows significant differences in the way Millennials think, compared to older users of the Internet, when it comes to online privacy, access to personal data and how they share information with businesses online.
The survey, conducted by the USC Annenberg Center for the Digital Future and Bovitz Inc., reveals a ?Millennial Rift? ? distinct differences in online behavior and core values among Millennials (ages 18-34) compared to other users, many of whom are only a few years older.
Privacy is dead
Millennials, the survey found, report more willingness to allow access to their personal data or web behavior and a greater interest in cooperating with Internet businesses ? as long as they receive tangible benefits in return.
?Online privacy is dead ? Millennials understand that, while older users have not adapted,? said Jeffrey I. Cole, director of the USC Annenberg Center for the Digital Future.
?Millennials recognize that giving up some of their privacy online can provide benefits to them. This demonstrates a major shift in online behavior ? there?s no going back.?
What they found
The survey found that compared to Internet users age 35 and older, larger percentages of Millennials report:
??More enthusiastic about sharing their personal information with online businesses.
? Greater receptivity to targeted advertising when their personal information is involved.
? More willingness to trade personal information in exchange for relevant advertising.
? Greater likelihood that they allow access to their personal data or information on their web behavior ? as long as they receive concrete benefits in return.
? Much larger numbers of online contacts and greater use of social networking.
What?s in it for me?
The survey found a large percentage of Millennials ? and an even larger percentage of users age 35 and older ? are uncomfortable with others having access to their personal data online or information about their web behavior.
When asked about the statement, ?No one should ever be allowed to have access to my personal data or web behavior,? 70 percent of Millennials agreed, compared with 77 percent of users 35 and older.
However, in spite of those views, significant percentages of Millennials compared to those age 35 and older are willing to give up some of that privacy ? if they benefit from it.
When asked if they would share their location with companies in order to receive coupons or deals for nearby businesses, 56 percent of Millennials agreed, compared to 42 percent of users 35 and older.
And when asked if they would share information with companies ?as long as I get something in return,? 51 percent of Millennials agreed, compared to 40 percent of those age 35 and older.
Different perception
?We are seeing a whole new set of values driving Millennials in their behavior online,? said Greg Bovitz, president of Bovitz Inc.
?The fact that Millennials are willing to part with personal information creates new opportunities for businesses to develop marketing models that capitalize on the wants of this generation of Internet users.?
Millennials are also more receptive than older users to accepting targeted advertising when their personal information is required.
When asked about the statement, ?I?m OK with trading some of my personal information in exchange for more relevant advertising,? 25 percent of Millennials agreed, compared to 19 percent of Internet users age 35 and older.
?Millennials think differently when it comes to online privacy,? said Elaine B. Related findings from the annual survey by the Center for the Digital Future also reveal that Millennials are more active on social networks compared to non-Millennials.
The survey also found that Millennials regularly contact many more people through social networking than users over 35 do. The average number of people whom Millennials regularly contact through social networking sites is 18, compared to only five for users over age 35.
Millennials are also more frequent users of social networking sites than older users; almost half of Millennials (48 percent) visit social networking websites several times a day, compared to only 20 percent of users 35 and older.

Boston bombings: Who's the mysterious 'Misha'?

Under the tutelage of a friend known to the Tsarnaev family only as Misha, Tamerlan gave up boxing and stopped studying music, his family said. He began opposing the wars in Afghanistan and Iraq. He turned to websites and literature claiming that the CIA was behind the terrorist attacks of Sept. 11, 2001, and Jews controlled the world.
"Somehow, he just took his brain," said Tamerlan's uncle, Ruslan Tsarni, who recalled conversations with Tamerlan's worried father about Misha's influence. Efforts over several days by The Associated Press to identify and interview Misha have been unsuccessful.
Tamerlan's relationship with Misha could be a clue in understanding the motives behind his religious transformation and, ultimately, the attack itself. Two U.S. officials say he had no tie to terrorist groups.
Throughout his religious makeover, Tamerlan maintained a strong influence over his siblings, including Dzhokhar, who investigators say carried out the deadly attack by his older brother's side, killing three and injuring 264 people.
"They all loved Tamerlan. He was the eldest one and he, in many ways, was the role model for his sisters and his brother," said Elmirza Khozhugov, 26, the ex-husband of Tamerlan's sister, Ailina. "You could always hear his younger brother and sisters say, 'Tamerlan said this,' and 'Tamerlan said that.' Dzhokhar loved him. He would do whatever Tamerlan would say.
"Even my ex-wife loved him so much and respected him so much,"said Khozhugov. "I'd have arguments with her and if Tamerlan took my side, she would agree: 'OK, if Tamerlan said it.'"
Khozhugov said he was close to Tamaran when he was married and they kept in touch for a while but drifted apart in the past two years or so. He spoke to the AP from his home in Almaty, Kazakhstan. A family member in the United States provided the contact information.
Tamerlan Tsarnaev was killed in a police shootout Friday. Dzhokhar Tsarnaev was charged Monday with using a weapon of mass destruction to kill, and he could face the death penalty if convicted.
"Of course I was shocked and surprised that he was Suspect No. 1," Khozhugov said, recalling the days after the bombing when the FBI identified Tamerlan as the primary suspect. "But after a few hours of thinking about it, I thought it could be possible that he did it."
Based on preliminary written interviews with Dzhokar in his hospital bed, U.S. officials believe the brothers were motivated by their religious views. It has not been clear, however, what those views were.
As authorities try to piece together that information, they are touching on a question asked after so many terrorist plots: What turns someone into a terrorist?
The brothers emigrated in 2002 or 2003 from Dagestan, a Russian republic that has become an epicenter of the Islamic insurgency that spilled over from the region of Chechnya.
They were raised in a home that followed Sunni Islam, the religion's largest sect. They were not regulars at the mosque and rarely discussed religion, Khozhugov said.
